By downloading or using GemSnap ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App. These terms apply to all users of the App.
GemSnap is an iOS application that uses artificial intelligence to help users identify rocks, minerals, and crystals from photographs. The App also provides specimen information, collection management tools, estimated market values, and authenticity guidance.
GemSnap's AI identification is provided for informational and educational purposes only. Identifications may not be accurate and should not be relied upon for commercial, scientific, medical, or safety-critical decisions.
We make no warranty that identifications are correct, complete, or suitable for any particular purpose.
GemSnap is licensed to you for personal, non-commercial use only. You may not:
All content within the App — including the AI model outputs, design, graphics, and text — is owned by or licensed to GemSnap. You retain ownership of photos you take. By scanning a photo, you grant us a temporary, non-exclusive licence to process it solely for the purpose of returning an identification result.
Reference specimen photographs sourced from Wikimedia Commons are used under their respective Creative Commons licences.

To the maximum extent permitted by applicable law, GemSnap and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to reliance on identification results, collection valuations, or authenticity guidance.
Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid for the App in the twelve months prior to the claim.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these terms.
We reserve the right to modify or discontinue the App or these Terms at any time. We will notify you of material changes where required by law. Continued use of the App after changes are posted constitutes acceptance of the updated terms.
These terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
